Chasecard Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Chasecard (“Chasecard,” “we,” “us,” “our”) governing your use of the Chasecard app and related services (the “Service”). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Chasecard is an independent app and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, or PSA / Collectors Universe. All trademarks are the property of their respective owners.

1. Who may use the Service

You must be at least 13 years old to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it. You are responsible for complying with all laws that apply to your use.

2. The Service

Chasecard helps collectors of graded trading cards scan cards, look up prices, track a portfolio, and evaluate deals — and is designed to work even on a poor connection. Scanning and portfolio tracking are free. We may add, change, suspend, or discontinue features at any time. The Service is provided for your personal, non-commercial use unless we agree otherwise in writing.

3. Market data and pricing — information only, not advice

Prices, population figures, sales history, deal evaluations, and any other market data in the Service are aggregated and estimated from public and licensed sources. They are provided for informational purposes only. They are estimates, not appraisals, and are not financial, investment, tax, or trading advice and not an offer or solicitation to buy or sell anything.

Market data may be inaccurate, incomplete, delayed, or out of date, and card values can change quickly. You are solely responsible for your own research and for any decision to buy, sell, hold, grade, or trade a card. Do not rely on the Service as your only source when money is at stake — verify independently before you transact. We do not guarantee the accuracy, completeness, or timeliness of any data, and we are not responsible for any loss arising from your reliance on it.

4. Scanning and card recognition

Card recognition runs on your device and is best-effort — it may misidentify a card, grade, edition, or certification. Always confirm a card’s identity, grade, and certification details yourself (for example, from the physical slab and the grader’s official records) before relying on them. Whether your scan images are uploaded to help improve our recognition models is controlled by the “Improve scanning” setting and our Privacy Policy; when that setting is off, scan images stay on your device.

You sign in with Google, Apple, or email. Keep your credentials secure; you are responsible for activity under your account. Provide accurate information, keep it current, and tell us promptly of any unauthorized use. Do not create an account for anyone else or share your account. You can delete your account at any time in the app (Profile → Delete Account).

You keep ownership of the content you provide (your collection data, corrections, scan images, and other submissions). You grant us a worldwide, non-exclusive, royalty-free license to host, store, use, reproduce, and process that content to operate, secure, improve, and develop the Service and our recognition models, consistent with your in-app choices and our Privacy Policy. You represent that you have the rights to the content you submit. If you send us feedback or suggestions, we may use them without obligation to you.

8. Intellectual property

The Service — including the app, software, recognition models, user interface, and the compiled selection, arrangement, and presentation of data — is owned by Chasecard and its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service under these Terms; all rights not granted are reserved. Card names, images, set names, grader names, and related marks belong to their respective owners and are used descriptively to identify cards; their use does not imply any affiliation or endorsement.

The Service is free today. If we introduce a paid subscription or other paid features, the following applies:

10. Third-party services and marketplaces

The Service relies on third-party providers (for example Google Firebase, Cloudflare, and Railway) and may show or link to third-party listings, marketplaces, or websites (for example eBay and auction houses). We do not control and are not responsible for third-party services, listings, prices, or transactions, and your dealings with them are solely between you and that third party, subject to their terms.

11. Copyright complaints (DMCA)

We respect intellectual-property rights and expect users to do the same. If you believe content available through the Service infringes your copyright, send a notice to our designated agent at support@chasecard.io (subject line “DMCA Notice”) including: (1) identification of the copyrighted work; (2) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (3) your name, address, telephone number, and email; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and (6) your physical or electronic signature. We may remove or disable access to allegedly infringing material and, for repeat infringers, terminate accounts. If your content was removed and you believe that was a mistake, you may send a counter-notice with the information section 512(g)(3) of the DMCA requires, and we will handle it as the DMCA provides.

12. Apple App Store

If you obtained the app from the Apple App Store, you acknowledge that these Terms are between you and Chasecard only, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR AVAILABILITY OF THE SERVICE OR ANY DATA. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that card identifications or values will be correct. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHASECARD AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON CARD IDENTIFICATIONS OR MARKET DATA OR FROM ANY PURCHASE, SALE, OR TRADE DECISION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Chasecard and its officers, employees, and agents from any claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law.

16. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

17. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and update the “Last updated” date above; material changes may also be announced in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of the United States and the State in which Chasecard is established, without regard to conflict-of-laws rules. Before filing any formal dispute, please contact us at support@chasecard.io so we can try to resolve it informally. To the extent permitted by law, you and Chasecard agree to resolve disputes in the courts located in that jurisdiction. Nothing here limits any right you have that cannot be waived under applicable law.
